2. Description of Service

Get Roofer Dallas is a lead generation and referral service only. We are not a roofing contractor, employer, agent, or broker for any Contractor. We facilitate connections by collecting information from Homeowners and referring it to Contractors. We do not guarantee the quality, pricing, timing, or any other aspect of the services performed by Contractors. All agreements and work are strictly between the Homeowner and the Contractor.

3. User Obligations and Information

3.1 For Homeowners: By submitting a lead form, you warrant that all information you provide is accurate and complete. You expressly consent to receive calls, texts, and emails from us and our partner Contractors regarding your inquiry, as detailed in our Privacy Policy.

3.2 For Contractors: Access to the Service and lead data is conditional upon a separate, signed Contractor Service Agreement. Any use of lead information is governed by that agreement and applicable laws, including telemarketing regulations.

4. Intellectual Property

The Service,its original content, features, and functionality are owned by Never Miss A Lead and are protected by international copyright and intellectual property laws. You may not copy, modify, or create derivative works of our Service.

5. Privacy and Data

Your submission of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

6. Limitation of Liability

To the fullest extent permitted by law,Never Miss A Lead shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or your interactions with any Contractor. Our total liability for any claim related to the Service shall not exceed the total amount of fees you have paid to us in the three (3) months preceding the event giving rise to the liability.

This limitation applieseven if we have been advised of the possibility of such damages and covers all claims, whether based on warranty, contract, tort, or any other legal theory.

7. Disclaimer of Warranties

The Service is provided on an"AS IS" and "AS AVAILABLE" basis. We disclaim all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any leads will result in closed business for a Contractor.

8. Indemnification

You agree to indemnify,defend, and hold harmless Never Miss A Lead from and against any and all claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your interactions with any other user of the Service (whether a Homeowner or Contractor).

We reserve the right to modify or replace these Terms at any time.We will provide notice of changes by posting the new Terms on this page and updating the "Effective Date." Your continued use of the Service after any such change constitutes your acceptance of the new Terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales,without regard to its conflict of law provisions. As a consumer, you may benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms, including this governing law clause, affects your rights as a consumer to rely on such mandatory provisions.
